Silver Is Now Legal Tender in Texas: What Houston Silver Bullion Owners Should Know in 2026

Texas HB 1056 took effect on September 1. Here is what it actually changes for your coins and bars, what it does not, and how to decide whether to sell, hold, or pawn.

The short answer

Since September 1, 2026, gold and silver bullion stamped with its weight and purity is legal tender in Texas under House Bill 1056. Businesses do not have to accept it, and the state's electronic payment system through the Texas Bullion Depository is targeted for as early as May 2027. The law does not change what your silver is worth: coins and bars are still priced from the global spot price, around $61 to $65 an ounce in late September 2026. In Houston, selling or pawning with a licensed buyer is still the fastest way to turn silver into dollars. Free quotes: (713) 766-2919.

Since the start of September, customers have been walking into our Heights and Medical Center showrooms with the same question: "Silver is money in Texas now, so should I spend it, hold it, or sell it?" It is a fair question, and a lot of what is circulating online makes the change sound bigger than it is.

This guide sticks to what the law says, what has not changed, and what it means in practice for anyone in Houston, Katy, Sugar Land, Pearland, or The Woodlands holding silver bullion: Silver Eagles, Maple Leafs, bars, rounds, or pre-1965 coins.

Silver bullion coins and bars now recognized as legal tender in Texas HB 1056 covers bullion stamped with its weight and purity.
What the law does

HB 1056 in Plain English

Governor Greg Abbott signed House Bill 1056 in June 2025. It recognizes gold and silver "specie," meaning bullion marked with its weight and purity, as legal tender in Texas starting September 1, 2026.

The law also directs the Texas Comptroller to build an electronic payment system. Texans will be able to deposit metal in the Texas Bullion Depository in Leander and spend it through a debit card that converts silver or gold into dollars at the register. That system is targeted for as early as May 2027.

The part people miss: acceptance is voluntary. No store, landlord, or lender is required to take your silver.

What Changed and What Did Not

QuestionAnswer in fall 2026
Is silver bullion legal tender in Texas?Yes, since September 1, 2026
Must businesses accept it?No, acceptance is voluntary
Can I spend it with a state debit card? Not yet, targeted for as early as May 2027
Do I have to use the state depository? No, participation is optional
How is my silver valued?Unchanged: the global spot price
Can I still sell or pawn it locally?Yes, exactly as before

In short, the law adds a new way to use silver in the future. It does not create a special Texas price, and it does not replace the everyday options you already have.

What sets the value

The Price Still Comes From the Market

Silver opened 2026 at about $71 an ounce and hit $115.15 on January 26. It has pulled back since, sliding to about $61 on September 28 as rate hike expectations pushed yields higher, according to Trading Economics.

Even so, that is still roughly 30% above where silver traded a year ago. A 10 oz bar that was worth about $470 in melt last fall is worth about $610 to $650 now. Legal tender status did not add a dollar to that, and it did not take one away.

The bigger picture

Where Bullion Demand Stands in 2026

According to the Silver Institute's World Silver Survey 2026, global silver coin and bar demand rose 14% in 2025, but the US posted its third straight year of declines as investors took profits during the rally.

For 2026, the Institute expects retail investment to keep growing and the silver market to run a supply deficit for a sixth year in a row. That backdrop supports silver over time, but it will not stop short term swings like the one this September.

For Houston owners, that means two things. There are active buyers for bullion, and there is no guarantee about next month's price.

How to decide

Sell, Hold, or Pawn Your Silver?

  • Sell if you need cash or want to lock in a price that is still well above last year.
  • Hold if you want to be ready for the state payment system, or you are comfortable riding out further drops.
  • Pawn if you need money now but want to keep your stack. You get your silver back when you repay.
  • Split it: sell generic rounds and junk silver, keep the Eagles or graded coins you care about.

Our pawn loans need no credit check. The program has a minimum repayment period of 61 days, a maximum of 12 months, and a maximum APR of 35%, and the amount depends on the value of the silver you pledge.

6 Tips for Houston Silver Bullion Owners

1

Watch Spot, Not Headlines

Legal tender news does not move your offer. The live silver spot price does, and it swung more than 4% in one day this September.

2

Keep Mint Packaging

Tubes, monster boxes, capsules, and assay cards make coins and bars faster to verify and easier to resell.

3

Sort Before You Sell

Separate Eagles, Maples, bars, rounds, and junk silver. Each is priced a little differently.

4

Check for Collector Value

Better date Morgan dollars and graded coins can be worth more than melt. Have them looked at first.

5

Never Clean Coins

Cleaning leaves hairline scratches that can erase collector premiums. Toning does not reduce silver content.

6

Pawn to Keep Your Position

If you believe silver will recover, a pawn loan gives you cash now and your coins back when you repay.

Texas Silver Legal Tender: Your Questions

Yes. Under Texas House Bill 1056, gold and silver specie, meaning bullion stamped with its weight and purity, became legal tender in Texas on September 1, 2026. Acceptance is voluntary, so no store or lender has to take it, and the state's electronic payment system is not expected until as early as May 2027.

No. The law does not set a price for silver. Your coins and bars are still valued by the global spot price, which traded around $61 to $65 an ounce in late September 2026. A buyer in Houston quotes from that same market price.

Only where a business agrees to it. Legal tender status means silver can be used to settle debts and transactions in Texas, but nobody is required to accept it. For most people, selling to a licensed buyer is still the practical way to turn silver into dollars.

No. Using the Texas Bullion Depository in Leander, and the payment system being built around it, is optional. You can keep your silver at home, in a safe deposit box, or with a private vault, and you can still sell or pawn it locally.

That depends on your needs, not on the law. Silver is down from its January 2026 high of $115.15 but still roughly 30% above a year ago. If you need cash, selling now captures a historically strong price. If you want to hold for a rebound, a pawn loan pays you today while you keep your stack.
